Breaking news! Just now, Minister of the Environment George Heyman and Attorney General David Eby announced the first three ways the BC government will be stopping Kinder Morgan.

The first is an incredible acknowledgement of principle of consent: Kinder Morgan has not consulted with First Nations appropriately and so there can be no fulfilment of the constitutional duty to consult until a proper consultation is done. This is a huge political change for BC and will have implications far beyond Kinder Morgan.

The government will also apply to be an "intervenor" in the 21 cases challenging the approval, increasing their likelihoods of success! Former Supreme Court Justice  Thomas Berger has been appointed as outside council. His experience fighting for First Nations and Indigenous rights and title will be invaluable and is another signal this government is taking First Nations consultation - and actual Reconciliation - seriously. 

The best for last: until these processes are done, there will be NO CONSTRUCTION on public land!

This is a huge blow to Kinder Morgan - but the fight is not over. 

Kinder Morgan can start construction on private land in September. The tank farm and Westridge Terminal in Burnaby are currently the most likely spots they'll start construction. We'll be there to stop them. Donate now to fund the resistance: www.CoastProtectors.ca/donate
