The Federal Court of Appeal dealt a major blow to the Trans Mountain pipeline expansion this August, overturning the federal government’s approval. The court cited two main failures:
1) the NEB didn’t consult with First Nations affected by the pipeline in a meaningful way and,
2) the NEB wrongly excluded the effects of increased shipping from its review. The NEB claimed there were no “significant adverse environmental effects” from tanker traffic. In fact, the court found that increased traffic threatens the endangered Southern resident killer whales. (Tyee August 30, 2018)
The new owner of the Trans-Mountain Pipeline Project, Canada, is having yet another review of the project.
